fa تألیف و نشر کتابهای درسی و حقوق دانش‌آموزان از دیدگاه اسلام و حقوق مالکیت فکری  تخصصي Special پژوهشي Research <div style="text-align: justify;">حق آموزش در حکم حقوق اولیه بشر، امری ضروری برای همه افراد جامعه است و تحقق&shy;‌پذیری آن نیازمند امکانات و ابزارهایی خاص است. کتابهای درسی، مهم‌ترین ابزار این امر قلمداد می‌شود که می‌بایست به‌طور مناسب و با روشی استاندارد و فراگیر و بدون تبعیض و قصد سودجویانه در اختیار آموزش‌گیرندگان و دانش‌آموزان قرار گیرند. این پژوهش با هدف تعیین وضعیت تألیف و نشر کتابهای درسی از لحاظ حقوق دانش‌آموزان و مالکیت فکری و همچنین حمایت از حق مؤلف و ناشر و صاحب اثر و حقوق جمعی گروه آموزش‌گیرندگان (دانش‌آموزان) انجام شده است. روش مطالعه، کتابخانه‌ای و تحلیلی- توصیفی است که با ارائه و تبیین نظریه‌های فقهای اسلامی و بررسی قواعد فقهی و تطبیق این قواعد با قوانین حقوق مالکیت فکری، تکلیف و حقوق اشخاص و دستگاههای اجرایی مسئول، اعم از پدیدآورندگان (مؤلفان)، ناشران و مصرف‌کنندگان (آموزش‌دهندگان و آموزش‌گیرندگان) را بررسی کرده و سرانجام، با توجه به نتایج به‌دست‌آمده، راهکارها و پیشنهادهای لازم را ارائه می‌&shy;کند تا از دستکاری و سوءاستفاده‌های غیرمجاز برخی اشخاص سودجو و فرصت‌طلب از کتابهای درسی که منجر به اختلال در نظام آموزش رسمی کشور می‌شود پیشگیری کند. بر اساس یافته&shy;‌های پژوهش انجام‌شده، از نظر فقه اسلامی و علمای حقوق مالکیت فکری، این حق مورد تأیید و حمایت قرار گرفته است.</div> <div style="text-align: justify;">The right to education, as a basic human right, is essential for all members of society, and its realization requires special facilities and tools. Textbooks are considered to be the most important tool that should be provided to learners and students in an appropriate and standard and comprehensive manner, without discrimination and not for profit. The aim of this study was to determine the status of writing and publishing textbooks in terms of students&#39; rights and intellectual property, as well as to protect the copyright of the author and publisher and the owner of the work and the collective rights of the group of learners (students). The study method is a library and analytical-descriptive that examines duties and rights of responsible persons and executive bodies, including creators (authors), publishers, and consumers (educators and learners) by presenting and explaining the theories of Islamic jurists and examining the jurisprudential rules and applying these rules to the laws of intellectual property rights and finally provides the necessary solutions and suggestions according to the obtained results to prevent the unauthorized manipulation and misuse of textbooks by some profiteers and opportunists, which leads to disruption of the formal education system in the country.
